Terms and Conditions

1. Definitions

  • “Customer” means any individual purchasing goods from the Shop for purposes outside of a business or trade.

  • “Boomtown” refers to Boomtown Festival Ltd, 126 Albert Road, Bristol, BS2 0YA.

  • “Upstream Printing Ltd” refers to our third-party partner at Unit 17, Bude & Stratton Business Park, Bude, Cornwall, EX23 8LY, responsible for manufacturing and fulfilment.

  • “Shop” means the online merchandise store operated under the Boomtown brand.

  • “Working Days” means Monday to Friday, 9 am to 5 pm, excluding UK Bank or Public holidays.

2. Orders & Contract

  • All contracts of sale by Boomtown incorporate these terms. Orders are subject to acceptance and availability.

  • Cancellations: We process cancellations in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014.

  • Verification: You undertake that all details provided for the purchase are correct and that the payment method used belongs to you. We reserve the right to validate payment details before fulfilling any order.

3. Prices & Payment

  • Prices include VAT and are charged in Pounds Sterling (£) at the price prevailing at the time of order.

4. Delivery, Title & Risk

  • Upstream Printing Ltd will use reasonable endeavours to despatch goods promptly. We are not liable for delays caused by third-party couriers or factors beyond our reasonable control (Force Majeure).

  • Risk: Risk of loss or damage passes to you upon delivery.

  • Title: Ownership of the goods passes to you only when Boomtown has received payment in full.

5. Your Right to Cancel

You have the right to cancel your order within 14 days without giving any reason.

  • The Period: The cancellation period expires 14 days from the day you (or a person you nominate) receive the goods.

  • How to Cancel: To exercise this right, you must notify Boomtown via email at merch@boomtownfair.co.uk. This provides a clear digital record of your request. While you may also notify us in writing to our Bristol office, email is the fastest way to process your request.

  • Effects of Cancellation: We will refund all payments received from you, including the costs of standard delivery. We may make a deduction from the refund for any loss in value of the goods if the loss is the result of unnecessary handling by you (e.g., items being worn or tags removed).

6. Returns & Refunds Process

  • Cost of Return: You are responsible for the direct cost of returning the goods to our fulfilment partner.

  • Returning the Goods: You must send back the goods to the address below without undue delay and no later than 14 days from the day you emailed us to cancel:
    Boomtown Returns, Unit 17, Bude & Stratton Business Park, Bude, Cornwall, EX23 8LY.

  • Refund Timing: We will process your refund within 14 days of receiving the goods back, or 14 days from the date you provide evidence (e.g., a tracking receipt) that you have sent them back.

7. Product Specifications & Substitutions

We make every effort to supply goods as advertised. If we cannot supply the specific item ordered, we may offer a substitute of equal or superior quality. If you do not wish to accept the substitute, you may cancel the order for a full refund. This is your sole remedy in these circumstances.

8. Intellectual Property

All content on the Shop, including text, graphics, logos, and imagery, is the property of Boomtown Festival Ltd. Unauthorised use is strictly prohibited.

9. General

  • Statutory Rights: Nothing in these terms affects your statutory rights (e.g., your right to a refund or replacement if goods are faulty).

  • Governing Law: These terms are governed by the laws of England & Wales.

  • Liability: Boomtown is not liable for any harm or damages related to the use of goods or third-party websites linked from the Shop.
